Whitsunday Regional Council has resolved to waive the development application lodgement fee for some development applications assessable under the Temporary Local Planning Instrument(TLPI) 02/2013.
Mayor Jenny Whitney said the waiving of fees under some specific circumstances is a direct result of community feedback received at the recent industry briefing session held in Bowen on the 21st February.
“During this briefing session a number of key themes and concerns relating to the application and implementation of the TLPI were identified by attendees and as a result Council is acting toaddress these concerns,” she said.
“In particular issues were raised about the TLPI covering areas which are known to be high areas which would not be affected by flooding.
“After discussion with Councillors it was identified in some instances development applications are considered ‘low risk’ and therefore an opportunity exists to reduce regulatory obligations,” she said.
Lodgement fees will be waived for development applications for a Material Change of Use (MCU) where it can be demonstrated that:
a) The subject site is identified within the Natural Hazard Trigger Area (on the Natural HazardTrigger Map), but is not within a mapped Defined Floor Level (DFL) (on Natural HazardExtent Map A & B); orb) The subject site has a current Operational Works approval where the approved naturalground level to be at or above the identified DFL; orc) The subject site can readily demonstrate, by submitting current survey levels, the existingnatural ground level is at or above the mapped DFL.
Mayor Whitney said development applications should be lodged to Council in the standard manner with an additional cover letter stating that a waiver of the application fee is being sought.
“Council will then confirm whether the relevant fee waiver requirements have been met,” she said.
“The amendment of the fees involved with the TLPI is a direct result of feedback gained from thecommunity through consultation.
“This is another example of Council adopting a more consultative approach and listening andacting on community concerns.
“This amendment was originally on the agenda for the adjourned March 26th Council meeting and if it was adopted then the building industry in Bowen could have been taking advantage of these fee amendments sooner.”
